Registering an NGO in India involves a few legal steps and documentation. Here’s how you can register your NGO:
1. Choose the Type of NGO
You must decide whether you want to register your NGO as a Trust, Society, or a Section 8 Company. Each has different requirements.
Trust: Registered under the Indian Trusts Act, 1882.
Society: Registered under the Societies Registration Act, 1860.
Section 8 Company: Registered under the Companies Act, 2013, with the Ministry of Corporate Affairs (MCA).
2. Draft the Constitution or Memorandum of Association
The constitution or memorandum should outline the objectives, structure, governance, and activities of the NGO.
3. Select the NGO’s Governing Body
The governing body should consist of at least 2-3 members (for a Trust or Society) or 2 directors (for a Section 8 Company).
4. Register the NGO
Trust: File the Trust Deed with the local sub-registrar.
Society: Submit the documents to the Registrar of Societies in your state.
Section 8 Company: Apply through the Ministry of Corporate Affairs (MCA) and get a license.
5. Obtain 12A and 80G Certificates for Tax Exemptions
Apply to the Income Tax Department for these certifications, which will help your NGO avail tax exemptions and provide tax deductions to donors.
6. Apply for FCRA (Foreign Contribution Regulation Act) Registration (if applicable)
If your NGO intends to receive foreign donations, apply for FCRA registration with the Ministry of Home Affairs.
7. Open a Bank Account
Once registered, open a separate bank account for your NGO for proper financial management.
